Our compassionate legal team provides expert guidance for individuals applying for VAWA, U visas, and T visas, empowering you to move forward with confidence and dignity.
Understanding VAWA, U Visas, and T Visas
Several immigration options exist for individuals who have experienced violence or exploitation. Each program is designed to protect and support survivors, offering a potential path to legal residency in the U.S. Here’s how we can assist you:
- VAWA (Violence Against Women Act) Self-Petition
The Violence Against Women Act (VAWA) allows survivors of domestic violence to self-petition for legal status without the abuser’s involvement. Although originally designed to protect women, VAWA protections apply to all genders and include spouses, children, and parents of abusive U.S. citizens or lawful permanent residents.
Who Qualifies?
- Spouses, children, or parents of a U.S. citizen or lawful permanent resident who has been abusive.
- Evidence of a good faith marriage (if applying as a spouse).
- Proof of abuse or extreme cruelty by the U.S. citizen or lawful permanent resident family member.
- U Visa (For Victims of Certain Crimes)
The U Visa is designed to help victims of specific crimes who have suffered significant harm and have been or are willing to assist law enforcement in investigating or prosecuting the crime. The U Visa grants temporary legal status and work authorization, with the possibility of applying for a green card after three years.
Who Qualifies?
- Victims of qualifying crimes such as domestic violence, sexual assault, human trafficking, or other violent crimes.
- Individuals who suffered substantial physical or mental abuse due to the crime.
- Victims who cooperate with law enforcement in the investigation or prosecution of the crime.
- T Visa (For Victims of Human Trafficking)
The T Visa provides protection to individuals who have been victims of human trafficking. This visa offers temporary legal status, work authorization, and a pathway to permanent residency after three years. Additionally, certain qualifying family members may also receive protection under this visa.
Who Qualifies?
- Individuals who have been trafficked into the U.S. for labor or sex.
- Victims willing to assist law enforcement in investigating or prosecuting their traffickers (some exceptions apply for minors or those suffering trauma-related challenges).
- Proof that the individual would suffer extreme hardship if removed from the U.S.
